Newport News Passes Ordinance Regulating Vape Shops

The Newport News City Council recently approved an ordinance amending the city’s zoning code to regulate new vape shops. According to the City, the decision follows months of study, public feedback, and recommendations from the Planning Commission. City leaders said the regulations aim to address concerns about illegal drug sales, youth access to vaping products, and the location of vape shops near schools and childcare centers.
Key provisions include:
Definition: Businesses where 20% or more of inventory, display space, or sales revenue comes from electronic cigarettes, vape products, vaporizers, or related accessories are classified as vape shops. General retailers and convenience stores fall outside this definition if such products account for less than 20%.
Location restrictions: New vape shops must be at least 2,000 feet from schools and childcare facilities.
Operating standards: Shops are limited to the C2 General Commercial zoning district, with hours restricted to 9 a.m.–9 p.m. Drive-thru service is prohibited. Windows must remain transparent, and signage must comply with city ordinances and state code governing the sale of tobacco, nicotine, and hemp products.
Existing businesses: Current vape shops may continue operating. If a shop closes for 24 months or longer, it must meet the new regulations before reopening.
“This ordinance is about protecting our children and families, not punishing responsible businesses,” said Mayor Phillip Jones. “We have heard the concerns of our residents, and this action ensures that new vape shops will meet strong community-driven standards.”
City officials emphasized that the ordinance does not ban vaping products but ensures accountability and safeguards public health.
